1. The Terms and Conditions set forth below apply generally to all the products and packages sold by VIP Travel into Africa
2. TERMINOLOGY
2.1. The term VIP Travel into Africa used herein means Brigitte C Erdmann – VIP Travel into Africa,registration no – 2004/101525/23 – VAT no: 4300216472
2.2. The term "Customer" as used herein means the purchaser of goods and/or services from VIP Travel into Africa.
2.3. The term "Product" as used herein means any service from the respective airline, wholesale companies and or other suppliers providing services, including accommodation and transportation services.
3. AGENCY
3.1. Products and services are sold by VIP Travel into Africa as a broker providing services, including accommodation and transportation services.
Vouchers are issued subject to the appropriate terms and conditions of sale of suppliers and these terms. They are issued by us as broker only. We have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products.
4. LIABILITY
4.1. VIP Travel into Africa has no liability for any act, omission or default, whether negligent or otherwise, of airlines, car rental operators, ferry companies, hoteliers, restaurant, coach companies or any other supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party.
We reserve the right to cancel or modify itineraries or bookings where circumstances require.
4.2. VIP Travel into Africa reserves the right to decline any booking for any individual on any tour or other service.
5. PASSENGER NAME/ROOMING LIST
5.1. It is essential that you the customer provide the details of each traveler correctly and according to
passport or other identification. Some suppliers will deny carriage if the traveler's name varies from your booking and may cancel automatically if the traveler's name is amended. VIP Travel into Africa has no responsibility for any loss or damage arising from incorrect entry of traveler's name any inability to travel as a result of carrier's policies.
6. UNLICENSED ENTITY DISCLAIMER
6.1. If you request VIP Travel into Africa to arrange for the provision of products or services by a person or company which is not licensed in accordance with any applicable law, VIP Travel into Africa accepts no liability (whether in contract, for negligence or otherwise) for any loss or damage suffered by you or any third party as a result.
7. AIR FARES – SPECIAL CONDITIONS
7.1. There are numerous rules and regulations affecting most advance purchase and other discounted air fares, which involve substantial cancellation or amendment fees, and in some instances there are no refunds whatsoever on cancelled holidays and or air tickets should you need to amend or cancel your travel plans. If you have any queries regarding these fees please do not hesitate to contact our office.
You must read the Rules and check the conditions applicable to every airfare and ensure that you accept those Rules and conditions before you make a booking. Once you confirm a booking and make payment you are bound by the Rules and conditions applicable to the relevant supplier.
8. ALTERATIONS TO TOUR ITINERARIES BY SUPPLIERS
8.1. In the event of material alterations by a supplier to a proposed tour booked by you, you may be given the option of cancelling the tour without penalty but this is not guaranteed. The right to cancel is subject to the conditions of the supplier. Your acceptance of any tickets, vouchers and receipts will be deemed acceptance of the above conditions and of any alterations made to your tour.
9. PHOTO ID
9.1. All airlines require the production of Photo ID when checking in with an e-ticket. Your ID must match with the name of the passenger on the ticket.
10. PASSPORT
10.1. All individuals traveling to Southern Africa must be in possession of a valid passport. It is advised that if your passport is due to expire within six months of your return.
11. ENTRY REQUIREMENTS
11.1. Certain neighboring countries require a Visa for entry prior to arrival. Please ensure you are fully informed of the requirements before you make a reservation as visas can take some time to obtain.
11.2. Vaccinations are strongly recommended for certain destinations. Please contact your local doctor who will advise you of these requirements. Please note that vaccinations may be recommended some period in advance of traveling.
12. TRAVEL INSURANCE
12.1. We strongly recommend that all clients take out travel comprehensive insurance when making a booking. We recommend that insurance covers loss of deposit and other monies through cancellation, loss or damage to personal baggage and loss of money, medical expenses, additional expenses to cover hotel accommodation and repatriation costs to your home country should any services need to be extended or curtailed due to illness or other insurable risk. Please note that restrictions on the time to effect insurance apply to some services such as airfares. Please enquire whether your credit card cover is sufficient. Customers declining this option will be required to sign an indemnity against VIP Travel into Africa.
13. RATES AND PRICE VARIATIONS
13.1. Rates quoted are per tour, per night accommodation, per crossing ferries, per package; as appropriate to the particular product. Car rental is based on a 24 hour period commencing from the time of pick-up throughout unless otherwise specified. All prices are subject to availability and can be withdrawn or varied without notice.
14. CURRENCY
14.1. All rates and prices quoted are quoted in South African Rand and as such are valid only in the republic of South Africa unless otherwise indicated.
15. PRICE INCLUSIONS AND EXCLUSIONS
15.1. Items included in the prices or rates of the products are specified in each section. Prices do not include, meals other than as stated in itineraries, any air fares unless stated, Government departure taxes, passport and visa charges, vaccination fees, airport taxes, any items of a personal nature such as telephone calls, beverages, laundry, excess baggage charges and gratuities, travel insurance or other items not specified.
16. VALUE ADDED TAX
16.1. Prices quoted include VAT (value added tax) as applicable to South African Financial Law.
17. SERVICE FEES
17.1. A surcharge may apply for credit card transactions (currently 5%).
18. The receipt of these terms and conditions signifies your agreement to indemnify and hold harmless the company, its employees for any personal injury, loss, disease, damage or expenses of whatsoever nature and howsoever arising, which you may sustain or incur by reason of any act or omission on the part or the company, its employees. No variation or alteration hereto shall be of any force or effect unless consented to in writing by VIP Travel into Africa and signed by you and VIP Travel into Africa.
19. GOVERNING LAW AND JURISDICTION
19.1. Each sale and other transaction between Customer and VIP Travel into Africa made under this Agreement will be governed by the applicable state laws for VIP Travel into Africa location, excluding any conflict of laws rules that may apply in such state. Any dispute regarding this Agreement shall be subject to the exclusive jurisdiction of the applicable court in the aforementioned VIP Travel into Africa location and each party submits to the jurisdiction thereof. Customer waives any defense to the validity or enforceability of this Agreement arising from any electronic submission of it to Customer.
